Agreement

This Century Pty Ltd does not sell alcohol to persons under the age of 18. By using this site you confirm that you are over the age of 18. This Century Pty Ltd makes every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 18. By using this site you are acknowledging that the person receiving a shipment of alcoholic beverages from This Century Pty Ltd is over the age of 18.

IF YOU DO NOT AGREE WITH THESE CONDITIONS OF USE PLEASE DO NOT USE THIS SITE. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 18, This Century Pty Ltd will prosecute you to the full extent allowable by law. If the person receiving the wine is unable to produce appropriate ID, our couriers will be unable to leave the wine.

Your order is an offer to buy from This Century Pty Ltd. There will be no contract of any kind between you and This Century Pty Ltd unless and until we accept your order, and in the case of wines and goods to be delivered to you, when we debit your credit card. At any point up until then, we may decline to supply the goods or services to you without giving any reason. At the moment we accept your order or in the case of delivery of goods, when we debit your credit card, a contract will be made between you and This Century Pty Ltd. All wines or other goods ordered remain the property of This Century Pty Ltd until payment is received in full. Our total liability to you for non-delivery of purchased goods is limited to the purchase price of the products.

This Century Pty Ltd shall not be liable for any delay in delivering your wine if that delay or failure is caused by circumstances beyond our control such as war, riot, civil commotion, malicious damage, compliance with any current or future law or governmental order, rule, regulation or direction, fire, flood, storm or other poor weather conditions, Act of God, failure of ISP or telecommunications provider in connection with the performance of this Agreement.

This Century Pty Ltd reserves the right to modify the terms, conditions and notices contained on this the website without notice to you. Your continued use of this website after any such change constitutes your agreement to such change. This Century Pty Ltd further reserves the right to change prices and other information on the website at any time without notice to you. The posting of prices and other terms of sale on this web site (shop.yarrayering.com) shall not constitute a binding agreement and This Century Pty Ltd is not obliged to sell products on such terms.

All content, including without limitation graphics, logos, text, images and other features, appearing on this website, and their associated copyrights, trademarks and other intellectual property are owned, controlled or licensed by This Century Pty Ltd. This content is protected by copyright separately and as a collective work or compilation under Australian and international copyright law and is the property of the This Century Pty Ltd, its licensors, or the party credited as the provider of the content or other third-party owners of the content, as the case may be. This Agreement is personal to you and you may not transfer, assign, or delegate this Agreement to anyone without the express written permission of This Century Pty Ltd. Any attempt by you to assign, transfer, or delegate this Agreement without the express written permission of This Century Pty Ltd shall be null and void.

This Century Pty Ltd makes no representations or warranties whatsoever that access to this website will be uninterrupted or error-free or that any information, software or other material accessible on or through this website is free of viruses or other harmful components. Your use of the This Century Pty Ltd website is at your own risk and you assume full responsibility for all costs associated with all necessary servicing or repair of any equipment you use in connection with your use of this website.

This Century Pty Ltd will not be liable for any damages of any kind arising from the use of this site, including without limitation direct, indirect, incidental, punitive or consequential damages.

For your convenience, This Century Pty Ltd may include links to other sites on the Internet that are owned or operated by third parties. When linking to such a site, you do so at your own risk. Risks & Warnings

Customers should also be aware of the following inherent risks and warnings:

· Alcohol should be consumed in moderation and never in conjunction with operating a motor vehicle or machinery.

· Women should not drink alcoholic beverages during pregnancy because of the risk of birth defects. Alcohol consumption may
 cause health problems.

· A case of wine is heavy, so extra care should be taken when lifting it. If you are concerned about the weight we advise that you
transfer the bottles 1 or 2 at a time.

· Red wine in particular may cause staining if spilt, so extra care should be taken.

· Sparkling wines can be volatile due to the build-up of gases. Extra care should be taken when opening these.

HOMESTEAD TERMS AND CONDITIONS

The terms and conditions for holiday letting, as agreed by both parties, are as follows. Failure to abide by these Terms and Conditions permits Yarra Yering, their servants and contractors to refuse access to the property amend the booking or apply additional changes, and/or terminate the booking and occupancy.

Minimum Stays

The Homestead has a minimum two night stay. On long weekends there is a minimum three night stay.

Accommodation

The Homestead is let for holiday purposes only.

The Guest bedroom and bathroom configuration is:

• 1 x Queen sized beds with ensuite including washbasin, shower and toilet

• 3 x Queen sized beds

• 1 x Bunk room with two King Single sized beds

• 1 x main bathroom including washbasin, separate shower, bath and toilet

Guests are not permitted to sleep in common areas.

Port-a-cot and high chair: A port-a-cot and high chair for one infant is available upon request. No additional charge.

Linen and towels: All linen, extra pillows and blankets, bathroom towels and swimming pool towels are provided. Port-a-cot sheets and blanket are supplied when requesting use of our port-a-cot.

Check in: From 3.30pm

Check out: By 10.30am

Please confirm your arrival time where possible so that the property can be prepared for you.

Guest access: Self check-in with the key located in a key safe accessed via supplied code.

Parking: Dedicated private undercover parking for two cars. Additional open air spaces for up to four vehicles by the house. Multiple extra vehicle spaces available at the nearby winery carpark.

Cleaning

The Guest/s are required to take proper and reasonable care of the Homestead, its contents and grounds. They must be left in the same clean, tidy and workable condition at the end of their stay. The Homestead must be kept in a clean and tidy condition throughout the stay.

The Homestead will be cleaned once vacated, however this does not include the handwashing, drying and storing of kitchenware, cleaning the BBQ and turning off the gas bottle, cleaning of any spills throughout the residence, repositioning furniture, removal of any rubbish that is not already placed in a properly filled bin.

An additional cleaning fee of $100 applies if the kitchen or BBQ areas are left uncleaned. For all other extra cleaning the Guest/s will be charged an additional fee at the discretion of Yarra Yering based on the cleaning required.

Late check out

The Guest/s agree to leave the Homestead no later than the checkout time specified in the booking confirmation, or another time as mutually agreed upon between the Guest and Yarra Yering. If Guest/s stay past the agreed upon checkout time without Yarra Yering’s approval, they will be asked to leave and an additional late checkout fee may apply. If late checkout impacts cleaning and upcoming bookings, Yarra Yering has the right to keep the security deposit and request additional payments to cover costs.

Security and Safety

Please ensure that all external doors and windows are locked when not at the property and upon check-out. Place the keys in the lock box and ensure it is locked.

All lights, fans, heating and cooling, taps, gas bottles and appliances must be switched off when not at the Homestead.

In the event of lost keys the Guest/s is responsible for locksmith fees and the cost of cutting replacement keys.

Working Vineyard Notice

The Homestead is located in close proximity to Yarra Yering’s working vineyard and winery. At certain times of the year, particularly during vintage around February to March, there may be extra noise, lights and movement from machinery and people working nearby from early morning through until late at night. We apologise for any disruption to your stay.

Policies

Smoking policy

Smoking is not permitted anywhere on the Yarra Yering property. If this policy has been breached, Guest/s will be charged an additional cleaning fee at the discretion of Yarra Yering based on the cleaning required.
Loss or damage of any property due to the Guest/s smoking anywhere on the Yarra Yering property will be prosecuted through appropriate channels.

Pets policy

Unfortunately no pets are permitted due to the Homestead’s close proximity to the vineyard and the biosecurity risk. If pets are found to be on the property Guest/s will be asked to checkout. An additional cleaning fee may be charged at the discretion of Yarra Yering based on the cleaning required.

Vineyard policy

Entering the vineyard is not permitted due to pest and disease security.

Glass policy

For the safety of everyone, glass is not permitted in the fenced pool area or beyond the Homestead grounds. Please clean up any breakages and notify Yarra Yering promptly if additional cleaning is required. An additional cleaning fee will be charged at the discretion of Yarra Yering based on the cleaning required.

Functions, Parties or Gatherings policy

Functions, parties or gatherings are not permitted unless otherwise agreed in writing prior to arrival.

The Guest/s are limited to a maximum of two people being invited to enter the Homestead and its grounds. The maximum number of people at the property must not exceed twelve people. Invited people must not stay overnight.

Conduct and noise policy

The Guest/s are expected to conduct themselves in a manner that promotes responsible consumption of alcohol, safety, security, comfort and convenience of all persons in the Homestead and surrounding properties. Any conduct contrary to this will allow Yarra Yering to terminate the occupancy immediately.

The Guest/s must comply with Yarra Ranges Council noise regulations which prohibit noise from their prescribed items such as music after 10pm Sunday to Thursday, and after 11pm on Friday to Saturday and on public holidays.

Fire danger policy

In the event of code red days, high fire danger or extreme weather conditions, we reserve the right, at our own judgement, to cancel a booking and issue a refund. We are not responsible for any expenses incurred or losses suffered by the Guest/s as a result of this decision.



Loss, Damage or Theft

Yarra Yering accepts no liability for any injury, debt, damage, loss, delay, expense or inconvenience caused directly or indirectly by Yarra Yering, employees or contractors. No responsibility is taken for any Guest/s personal property. The Guest/s are strongly recommended to obtain their own insurance.

Maintenance

In order to maintain the high standards of the property, Yarra Yering schedules regular maintenance. Yarra Yering will attempt to schedule maintenance outside of your stay at the property, however occasionally this will be unavoidable.

Agreement

Nothing in this agreement shall compromise Yarra Yering’s right to issue legal proceedings in Victoria or elsewhere at their discretion seeking damages and/or punitive relief for any express or implied breaches of this agreement and/or any claim that may arise by reason of negligence and/or wilful damage of the Guest/s and/or invitees whatsoever. This agreement shall constitute the whole agreement between the parties and any express and/or implied warranties imposed upon Yarra Yering or their servants and contractors by legislation or law to the extent that it is possible are expressly excluded.
